These terms of use govern your access, use of the website, membership details and membership expectations. The website is available for your use only on the condition that you agree to the terms and conditions set forth below. If you do not agree to all of the terms of use, do not access or use our website. By accessing the website and/or memberships, you are bound by these terms of use.

These terms shall be constructed in accordance with UK laws. The waiver of any provision of these Terms shall not be considered a waiver of any other provision of our right to require strict observance of each of the terms herein. If any provision of these Terms is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full effect.

We reserve the right to modify or amend the Terms from time to time without notice. Your continued use of our website following the posting of changes to these terms will mean you accept those changes. Additional terms and conditions may apply to the purchase of products, such as cancellation policies. By using this website you agree to such terms and conditions as well as these Terms and our Privacy Policy.

You agree to provide us with complete and accurate information when you register for an account and keep the information current. This is important because sometimes we may need to send you notable updates (for example, about changes to our Terms of Service or Privacy Policy), or we may want to let you know about them and make informed choices in response to legal inquiries or complaints. You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure. You are responsible for maintaining the security of your account and any Service related website, store, or other content. You are fully responsible for all activities that occur under your account and any other actions taken in connection with our Services. You shall not share or misuse your access credentials. You must immediately notify us of any unauthorised uses of your account, store, or website, or any other breach of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

2. Fees, Payment, and Renewal

a. Some of our Services are offered for a fee. By using a Paid Service, you agree to pay the specified fees and fees associated with specific features. Depending on the Paid Service, there may be one-time fees, recurring fees, or revenue-based fees. For recurring fees, we’ll bill or charge you in regular automatically-renewing intervals (such as monthly, annually, or biennially), on a pre-pay basis until you cancel, which you can do at any time by contacting the relevant support team.

b. If your payment fails or if Paid Services are otherwise not paid for or paid for on time, we may immediately cancel or revoke your access to the Paid Services. If you contact your bank or credit card company to decline or reverse the charge of fees for Paid Services, we may revoke your access to our Services in general.

c. We may change our fees at any time, or start charging fees for Services that were previously free. When applicable, we may give you advance notice of the fee changes. If you don’t agree with the fee changes, you must cancel your Paid Service.

d. While you may cancel a Paid Service at any time, refunds are issued at our sole discretion, unless otherwise required by applicable law.

3. General Representation and Warranty Page

You represent and warrant that your use of our Services will be in strict accordance with these Terms:

  • will comply with all applicable laws and regulations (including, without limitation, all applicable laws regarding online conduct and acceptable content, privacy, data protection, the transmission of technical data exported from the United States or the country in which you reside, the use of financial services, notification and consumer protection, unfair competition, and false advertising);
  • will not use the Services for any unlawful purposes, to publish illegal content, or in furtherance of illegal activities;
  • will not infringe or misappropriate the intellectual property rights of any third party;
  • will not overburden our systems, as determined by us in our sole discretion;
  • will not disclose sensitive personal information of others;
  • will not be used to send spam or bulk unsolicited messages;
  • will not interfere with, disrupt, or attack any service or network; and
  • will not be used to create, distribute, or enable material that is - or that facilitates or operates in conjunction with - malware, spyware, adware, or other malicious programs or code.

5. Copyright Infringement

As we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe that material located on or associated with one of our products or services violates your copyright, please notify us. We will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material. We will terminate a visitor’s access to and use of the website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of our service. In the case of such termination, we will have no obligation to provide a refund of any amounts previously paid to us.

6. Age:

The premises licence holder must ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. This must as a minimum require individuals who appear to the responsible person to be under the age of 18 years of age to produce on request, before being served alcohol, identification bearing their photograph, date of birth, and a holographic mark. This can include, for example:

  • A photo card driving licence
  • A passport
  • A proof of age card bearing the PASS hologram

7. Behaviour, Consent and Ethic expectations

1. BehaviourExpectations

1.1 Respect the community - Dominium Vita is about being part of a community, and so we expect all our members to be kind and courteous towards each other. If you are found to be making another member uncomfortable or uneasy, you will have your membership revoked.

1.2 No photos or videos - We have a strict no photo/video policy in all of our events. Upon arrival, you will be asked to cover your phone cameras with a sticker which will be provided to you.

1.3 Respect our team - our staff are always there to help, but we will not tolerate any rudeness or harassment towards them. Dominium Vita team members are still a part of this community, this means you cannot touch them without their permission and must respect them as you respect others.

1.4 Don’t be a drunk - if anyone is found to be too intoxicated at a Dominium Vita event, for the safety and security of our members, you will be asked to leave and risk having your membership revoked.

1.5 No smoking - For health and safety, Dominium Vita has a strict no-smoking policy both in and outside all our play event venues. E-cigarettes and Vapes are permitted.

1.6 No pressure - No one attending a Dominium Vita event should feel pressured into participating in any activity they do not want to.

1.7 Don’t be phobic - Dominium Vita will not tolerate any racist, homophobic, transphobic or discriminatory remarks of any kind towards guests or the team. This includes classism, fetishisation, body shaming, abuse of power dynamics or kink shaming.

1.8 Let us know - if you see or hear anything that makes you uneasy or goes against any of our policies, please report it immediately to a Dominium Vita team member. By doing so you are helping keep the Dominium Vita community a safe and secure space and prevent others from being exposed to inappropriate or unacceptable behaviours.

2. Consent expectations

2.1 Do not touch anyone without their permission

2.2 Do not interrupt a scene - this means if people are in the middle of the play, you cannot just walk up and touch them, or expect to get involved. If someone looks as though they want you to get involved, always ask first. If you are declined from joining a scene, react appropriately, do not take this personally as there are a number of reasons why this could happen. Please speak to a member of the team if you need to understand a situation better.

2.3 Voyeurism - If you like to watch, that is openly encouraged however, be conscientious. Be aware of how your presence will make others feel or may distract a scene. We expect you to respect personal space and not disrupt the scene.

2.4 No solo play - The people being watched are not able to give permission or consent, making this a non-consensual act.

2.5 Please remember you are in a shared space, so whilst we do want you to let your hair down and enjoy, please be aware others may want to play in the same room or space.

2.6 Make sure you keep areas clean and hygienic. Our team will always be on hand to help, but please use the bins and wipes provided to clean your areas and try to leave areas as you found them so others can enjoy them.

2.7 If you are playing near others, please do not interrupt their scene. Even mid-play, consent must be given before you touch anyone else.

2.8 Condoms - Dominium Vita expects you to follow health and safety guidelines and use
protection with all partners. However, this is up to the individual's discretion, responsibility and risk. If play occurs without protection, all parties must have given consent beforehand and accept responsibility for this.

3. Using the apparatus

3.1 Any individual using any BDSM apparatus at a Dominium Vita event must understand and consent to any activities performed on said apparatus.

3.2 Safe words must be given and agreed upon before the use of any BDSM equipment. If someone is blindfolded and restrained this must be a verbal safe word. If an individual has consented to be gagged, then a nonverbal safe word must be agreed upon by both
parties. Once you have entered the verbal contract with the Dom, it is your responsibility to use safe words.

3.4 Each individual using any of the equipment or apparatus on hand at a Dominium vita event takes full responsibility for their well-being during any play or activities at that time.

3.5 If you feel unsure about using any of the equipment or apparatus at a Dominium Vita event, it is up to the individual to bring this to the attention of a member of the safeguarding team at Dominium Vita, one of the hosts Richard & Emma, or one of the professional doms in the space. They will then be happy to explain how to use the equipment safely.

4.0 Sanctions

4.1 If any of the Dominium Vita team or other members find your behaviour questionable, your membership will be placed on hold for a period agreed by management (2 months minimum), until the Dominium Vita team feel as though you will be a safe and proactive member of the community. Furthermore, if a formal complaint is made against you, Dominium Vita reserve the right to place your membership on hold for any extended period until an in-house investigation has been actioned by management and a conclusion to the issue is found.

4.2 If you are found to have broken any of our behaviour or consent expectations, your membership will be instantly revoked and you will be banned from any future Dominium Vita events.

4.3 If an issue is reported to us that occurred outside of Dominium Vita, that could concern the safety of other Dominium Vita members, we reserve the right to cancel membership.

5. Reporting an issue or concern

5.1 If you are concerned about any behaviour or activities during a Dominium Vita event, as stated above (see 3.5) please make sure you reach out to one of our safeguarding team members as soon as possible at the event. This will help to keep our community safe and secure for all those who attend. All safeguarding ‘Ethical Slut’ team members will be wearing red LED armbands which are available throughout any Dominium Vita event. The hosts, Emma & Richard are also available to speak if you are not able to find another team member.

5.2 If for any reason you are not able to flag something during an event, you can email us at info@dominiumvita.com to report the issue.

5.3 If an issue is reported to us that occurred outside of Dominium Vita (see 4.3), this must be supported with either documentation, confirmation by another event organiser or confirmation from an unbiased party. If confirmation cannot be given, Dominium Vita reserve the right to sanction as they see fit.

For GDPR, Richard Burton will be the “controller” of all personal data we hold about club members and others. Richard Burton is responsible for making sure the club complies with the General Data Protection Regulation (GDPR) which applies from 25 May 2018. We will review personal data every year to establish whether we are still entitled to process it or not.

8. Member’s rights

You have rights under the GDPR:

  • To access your personal data
  • To be provided with information about how your personal data is processed
  • To have your personal data corrected
  • To have your personal data erased in certain circumstances
  • To object to or restrict how your personal data is processed in certain circumstances

We hold the right to remove a membership or information regarding a membership if we believe it violates our terms of use. We can refuse to provide or stop providing all or part of the service to you if you create risk or legal exposure for us, and violate these terms of use or our policies.

Specific use and sharing of personal information

Your personal data (name, social media handle, sexual orientation and preferences, date of birth and contact details) will be used to ensure you can attend an event. In general, your personal data will only be used for the purposes of membership management (renewals etc.) and your email and telephone numbers may be used for communication about news at Dominium Vita. Your personal data will not be passed to anyone else outside the club and your email will only be given to someone outside the club with your permission.

The Lawful reasons for processing your data.

We have three lawful reasons for processing your data, which are:

(a) Processing is necessary for compliance with our legal obligation.

(b) Processing of your data is necessary for the administration of your membership contract.

(c) You have given consent to the processing of your data by applying via our membership form for the purposes set out in this policy.

The tables below give further explanation of which lawful reason applies to which data, why we collect it and who we may be required to share it with. Dominium Vita will make every effort to ensure data is only shared with GDPR-compliant organisations.

Please note data processed for compliance must be kept for 1 year from the end of your membership and is therefore exempt from your right to erasure under GDPR

9. Enquiries and other communications with the club

When enquiring about Dominium Vita we may hold your details for a period to deal with the enquiry. Any emails and other communications with the club will only be retained for a period of time appropriate to the content or request. Club emails will be purged regularly. People added to a waiting list for membership will be informed and asked for permission to store that data at that point.

10. Membership Age

No one under the age of 18 will be granted membership.

11. How we protect your personal data

The Data Controller will process membership information electronically and hold all information on a database on a secure cloud. For any online payments which we take from members, probationers, visitors and guests we will use a recognised online third-party secure payment system. In the unlikely event of a breach of the security of data, we will notify members promptly and we will never sell or pass on your personal data.

12. Request to see your personal information

If you wish to know what personal data the club holds please email info@dominiumvita.com and he/she will respond within 14 days of the request (depending on availability).

13. Accuracy and retention of data

Each member is responsible for keeping Richard Burton informed of changes to their data (e.g. address/telephone number etc. and this is updated at least once a year at renewal and you are at that time authorising the club to hold such data on file.
